Casino's email to selectmen sparks flap

Wynn: Invitation to board was in error
FOXBORO - With nerves frayed in town over a prospective casino on Route 1, a Wynn Resorts email instructing Foxboro's selectmen how to log into a conference call with Wynn and Kraft Group representatives has led to strong responses - including an Open Meeting Law warning - from town officials.
Michael Britt, vice president of community and government affairs for Wynn Resorts, sent an email to Wynn and Kraft Group representatives and to all five Foxboro selectmen late Monday morning, giving them the codes to access a half-hour conference call set to start five minutes later, at noon.
Britt, two minutes later, sent out a cancellation notice.
Town Manager Kevin Paicos, who was also on the recipient list, warned Britt in an email the conference call could be illegal.
He wrote: "I am unclear what this conference call was to be about, but if it is information regarding the casino proposal I believe such communication is a clear violation of the Mass. Open Meeting Law. I would strongly urge that you have no further communication with the members of the Board of Selectmen except at a public meeting." Paicos welcomed Britt to phone him if he wanted to discuss the matter.
Noting that Britt's cancellation also read, "This appointment occurs in the past," Selectwoman Lorraine Brue voiced concern about what that meant.
WHO AND WHEN?
"I believe that this may have been intended to be a high-level strategy conference call, and I don't know how the Foxboro selectmen email group could become associated with this call," Brue said Wednesday night.
Selectmen Chairman Larry Harrington said he has participated in no such conference calls, and complained about the way he's being treated by anti-casino campaigners.
"I know nothing about any prior conference calls and have not participated in such," Harrington wrote in an email.
Harrington voted in the board's 3-2 majority last week to let Wynn Resorts make a presentation to residents. He said Wednesday that an email to the board that day is instructive.
"It was from a soldier who has fought for democracy around the world and wants ... the proposal heard, too. Men and women have risked their life for democracy and in a democratic nation, all voices are heard, not just the loudest or those proclaiming to be the majority," he wrote. "I have taken criticism, threats, innuendoes, and so much more because I support the rights of EVERYONE to be heard."
Contacted by The Sun Chronicle about the positions of the email recipients, Wynn Resorts instead issued a statement saying that the Dec. 19 conference call "was intended as an internal communications call scheduled with the Kraft and Wynn groups. Due to a clerical error, [Sure! Blame it on a low level employee!] other individuals were invited to the call. As soon as the error was noticed, the call was rescheduled with the appropriate original participants."
Kraft Group Vice President Dan Murphy was one of the original recipients.
Among the other recipients, Brue said, were political and marketing consultants, a prominent Boston law firm, and Wynn organization's legal counsel.
